Fees

Can the fee be adjusted?

Yes. If you apply for legal aid, an adjusted fee may be offered depending on your personal situation.

How are the attorney’s fees determined?

Fees are governed by Article 10 of Law No. 71-1130 of December 31, 1971. They are determined by taking into account in particular:

› the client’s financial situation,
› the complexity of the case,
› the costs incurred,
› the attorney’s reputation,
› and the work performed.

Is a fee agreement mandatory?

Yes. A written fee agreement must be concluded between the attorney and the client.

⚠ No work can be carried out until this agreement is signed.

What billing methods are offered?

Several remuneration methods may be considered, depending on the nature of the case and the client’s situation:

› Flat fee
When possible, fees may be set in advance as a global flat rate.

› Hourly billing
When the case is complex, fees are calculated based on the actual time spent, at an appropriate hourly rate.

› Success fee
In certain cases, a success fee may be agreed upon in addition to a fixed fee, corresponding to a percentage of the final result obtained.

› The most appropriate remuneration method is systematically proposed based on the case and the client’s situation.

Is installment payment possible?

Yes. Installment payment of fees may be considered, subject to prior agreement.

Can fees be covered by insurance?

If you have legal protection insurance, it may, depending on your contract, cover all or part of the fees.

It is recommended to check your coverage with your insurer before any proceedings.

Can I be reimbursed by the opposing party?

At the end of litigation, the judge may order the opposing party to compensate you:

› in civil matters (Article 700 of the Code of Civil Procedure),
› in criminal matters (Article 475-1 of the Code of Criminal Procedure),
› in administrative matters (Article L. 761-1 of the Code of Administrative Justice).

This compensation is intended to cover all or part of the costs incurred, including attorney’s fees, subject to the court’s discretion.

Do you accept legal aid?

Yes. Maître Jeffrey Fauvin accepts cases under full or partial legal aid for all types of disputes.

⚠ Exceptionally, intervention may be refused due to the complexity of the case or the amount of work required.
